Stephanie ter Brake and Heleen Kleinjan publish AI article in Tijdschrift Ondernemingsrechtpraktijk

Directors are increasingly confronted with complex choices regarding the use of artificial intelligence within their organisations. New and existing regulations—including company law, the GDPR, the AI Regulation and the NIS2 Directive—not only require them to oversee the use of AI, but also to make strategic decisions on governance, risk management and the allocation of responsibilities. This calls for a fundamental understanding of both the technology and the legal frameworks that apply to it.

In their article, Stephanie ter Brake and Heleen Kleinjan examine the extent to which directors of Dutch companies are expected to have knowledge of AI, and how they should position themselves in light of rapidly evolving legal standards. They explore the impact of AI on directors’ core responsibilities and provide practical guidance on designing a future-proof governance structure.
